1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of KriptoK’s mobile applications, websites and related interfaces (the “Services”), operated by Sanal Kasam Teknoloji Anonim Şirketi (“KriptoK”, “we”, “us” or “our”).
By accepting these Terms or accessing or using the Services after they have been made available to you, you agree to be bound by them. If you do not agree, do not use the Services.
Certain features, including Packs, require separate acceptance of additional terms presented through the relevant feature.
KriptoK League rules and disclaimers are published on the KriptoK League website and accessible through its footer. Applicable third-party terms govern the third-party services you use.
Feature-specific KriptoK terms take precedence over these Terms only for the matters they expressly address.
2. Services and Our Role
KriptoK provides a self-custodial digital asset wallet and interfaces through which eligible users may access:
• Digital asset transfers, swaps and bridges.
• Third-party decentralised finance, yield and staking services.
• Perpetual futures trading powered by Hyperliquid.
• Randomised collectible packs (“Packs” or “Gacha”) provided by Collector Crypt.
• KriptoK League, leaderboards, trader profiles and community features.
Availability varies by location, provider and the features enabled in your version of KriptoK.
We do not hold or control your wallet seed phrase or private keys. Assets you transfer to a protocol, trading account, vault or third-party provider are subject to that service’s rules, permissions and withdrawal conditions. Self-custody does not eliminate protocol or counterparty risk.
KriptoK does not operate the Hyperliquid protocol or provide or fulfil Collector Crypt cards. Access through KriptoK does not constitute a guarantee of any provider, asset, trading outcome or collectible value.
3. Eligibility and Geographic Restrictions
You must be at least 18 years old, meet any higher minimum age applicable to a particular feature, and have legal capacity to enter into these Terms.
You may use a feature only where permitted by applicable law and the eligibility requirements of KriptoK and the relevant provider. You must not be subject to sanctions that prohibit the relevant activity or act on behalf of a prohibited person.
Perpetual futures and related trading competitions are not available through KriptoK to users located in or resident in the United States, or to UK retail users. Additional jurisdiction and provider restrictions may apply. Packs may have separate age and geographic restrictions.
Availability of the app does not establish eligibility for every feature.
4. Wallet Security and User Responsibilities
You are responsible for:
• Securing and backing up your seed phrase and private keys.
• Protecting your devices, PINs and any trading permissions you approve.
• Reviewing transaction details, networks, recipient addresses, contract approvals, order settings and fees before authorisation.
• Monitoring your positions and revoking permissions you no longer wish to maintain.
• Complying with applicable laws and the terms of the services you use.
We cannot recover a lost seed phrase or private key or restore access to assets solely because you have lost them.
You must not use the Services for fraud, unlawful activities, market manipulation, manipulation of competition results or unauthorised access. You must not introduce malicious code, exploit vulnerabilities or interfere with the Services. Reverse engineering is prohibited except where applicable law permits it.
5. Swaps, Bridges and Yield Services
Swaps, bridges, yield and staking features rely on third-party protocols and providers whose applicable terms and risks govern their services.
Quotes, estimated returns and completion times are indicative and may change before execution. Transactions may experience slippage, price impact, delays, partial completion or failure. Network or provider fees may still be incurred.
Yield rates are variable and are not guaranteed. Assets may be subject to withdrawal restrictions, lockups, liquidity shortages, validator penalties or protocol losses. Stablecoins may lose their peg, and bridged or wrapped assets may become impaired or unredeemable.
You may lose some or all assets committed to these services.
6. Perpetual Futures Powered by Hyperliquid
KriptoK provides an interface for submitting user-authorised orders to Hyperliquid. Execution, margin, funding, settlement and liquidation are governed by the relevant protocol and market rules.
By using this feature, you acknowledge the applicable Hyperliquid terms and risk disclosures presented through the trading interface.
• Leverage and liquidation: Leverage amplifies gains and losses. Small adverse price movements may cause liquidation and the loss of all collateral supporting your positions.
• Cross-margin risk: Cross-margin positions may put other collateral in the same cross-margin account at risk.
• Fees and funding: Trading fees and funding payments affect your equity, returns and liquidation risk.
• Execution risk: Orders, including stop-loss and take-profit orders, are not guaranteed to execute at the requested price or at all.
• Availability and data: Network interruptions, insufficient liquidity, oracle issues or service outages may prevent you from opening, changing or closing positions. Displayed prices, profit and loss and liquidation estimates may be delayed or differ from execution values.
Perpetual contracts referencing stocks, indices, commodities or other assets do not themselves grant ownership of the underlying assets, shareholder rights or an entitlement to physical delivery.
KriptoK does not guarantee execution, liquidity, trading outcomes or protection against liquidation.
7. Packs and Collector Crypt
Packs contain randomly allocated collectible cards. The card you receive may be worth less than the pack price. No particular card, rarity or value is guaranteed.
Gacha cards and their underlying physical collectibles are provided and fulfilled solely by Collector Crypt Corp. (“Collector Crypt”), not by KriptoK.
Before accessing Packs, you must accept the separate KriptoK Packs Terms and Collector Crypt’s applicable terms. By purchasing or interacting with a Gacha card, you agree to be bound by Collector Crypt’s terms and conditions, available through the Packs interface and at collectorcrypt.com, as amended from time to time.
Collector Crypt is responsible for the underlying cards and collectibles, including their sourcing, authenticity, grading, condition, storage and safekeeping, and for buyback offers, redemption, delivery and shipping in accordance with its terms.
KriptoK does not control or assume responsibility for these matters and does not fund or guarantee Collector Crypt’s buybacks. Related taxes, duties and customs obligations are governed by Collector Crypt’s applicable terms and applicable law.
Claims or disputes concerning Gacha cards or their underlying collectibles must be directed to Collector Crypt. KriptoK may facilitate communications through its support channels for convenience, but this does not make KriptoK responsible for Collector Crypt’s products or obligations.
This section is subject to Section 13 and does not exclude any rights or liabilities that cannot lawfully be excluded.
8. Fees and Taxes
Transactions may incur network fees, protocol fees, trading fees, funding payments, swap or bridge charges, and KriptoK service or integration fees.
KriptoK may receive builder fees on Hyperliquid trades, swap integration fees, referral payments or revenue shares from third-party providers, including Collector Crypt.
Applicable KriptoK charges or their calculation basis will be disclosed before you authorise the relevant transaction or fee permission. Builder-fee authorisation is separate from acceptance of these Terms and applies within the approved maximum. You may revoke that permission through the supported protocol mechanism.
Network costs, funding and execution-dependent amounts may vary.
You are responsible for taxes arising from your activities where required by law. This does not remove any legal obligation imposed on us or a provider to collect, withhold or report tax.
9. KriptoK League and Community Features
KriptoK League and other competitions are governed by their separately published eligibility, scoring, qualification and prize rules. KriptoK League rules and disclaimers are available through the footer of the KriptoK League website.
Leaderboards, trader profiles and performance data may be delayed, estimated or corrected under those rules. Rankings and past performance do not guarantee future returns or prizes.
Apple and Google do not sponsor, administer or endorse KriptoK League.
Community posts and other users’ trades are not advice or recommendations from KriptoK. You must not post unlawful, misleading, abusive or infringing material or disclose another person’s private information. We may moderate content and restrict accounts that breach applicable rules.
You retain ownership of content you submit and grant us a non-exclusive licence to host, display and technically process it as necessary to operate the relevant community features.
10. General Risks and No Advice
Digital assets and collectibles can be highly volatile, illiquid or lose their entire value.
Blockchain transactions are generally irreversible. Smart-contract bugs, compromised permissions, hacks, network failures, oracle errors and provider insolvency or misconduct may cause loss or prevent access to assets.
Prices, valuations, yields, charts and other information may be incomplete, inaccurate or delayed. Security reviews and audits do not eliminate risk.
Nothing in the Services constitutes personalised investment, legal or tax advice, a recommendation to transact, or a guarantee of profit. You make your own decisions and should use only amounts you can afford to lose.
11. Intellectual Property
KriptoK’s software, interface, branding and content are owned by or licensed to us.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose. No ownership of our intellectual property is transferred.
Third-party assets and brands remain subject to their owners’ rights and applicable licences.
12. Privacy and Data
Our Privacy Policy explains how we process personal data and how you can exercise your rights. Acceptance of these Terms is not blanket consent to processing that requires separate consent.
Blockchain addresses and transactions may be publicly visible and cannot generally be erased. Participation in public leaderboards, profiles or chat may make associated information visible as described in the relevant feature and Privacy Policy.
Third-party providers process personal data under their own privacy notices.
13. Warranties and Limitation of Liability
To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis, without warranties of uninterrupted operation, accuracy, suitability for a particular purpose or freedom from errors. We do not warrant that a third-party provider will perform its obligations.
To the extent permitted by applicable law, KriptoK is not liable for indirect or consequential losses, lost profits or lost business opportunities arising from use of the Services.
We do not assume responsibility for trading losses, random pack outcomes or failures of independent networks and providers merely because you accessed them through KriptoK.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence or any liability that cannot lawfully be excluded or limited. These Terms do not remove mandatory consumer rights or relieve us of responsibility for our own acts or omissions where applicable law makes us responsible.
14. Amendments
We may update these Terms for product, security, operational or legal reasons.
We will give reasonable advance notice of material changes through the app, website or another appropriate channel, unless an urgent security or legal requirement prevents this. The notice will state when the changes take effect.
We will request renewed acceptance where required by law or the nature of the change. Otherwise, continued use after the notified effective date constitutes acceptance to the extent legally permitted. Changes will not retrospectively remove accrued rights.
15. Suspension and Termination
We may restrict or suspend access where reasonably necessary to address a breach, suspected fraud, security concerns, provider restrictions or legal requirements. Where lawful and practicable, we will explain the restriction and provide a way to contact us about it.
You may stop using the Services at any time.
Suspension, termination or uninstalling KriptoK does not automatically close positions, cancel orders, revoke approvals or redeem assets. You remain responsible for managing those obligations.
Restricting access to our interface does not itself transfer ownership of your assets to us or give us custody of them.
Data retention and deletion are governed by our Privacy Policy and applicable law. Public blockchain records remain unaffected.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Türkiye.
Subject to mandatory jurisdiction rules, disputes fall within the jurisdiction of the competent courts in İstanbul.
This does not deprive consumers of mandatory protections or rights to bring claims before a competent court, consumer arbitration committee or other authority available under applicable law. Any mandatory pre-action or mediation procedure continues to apply.
17. Severability
If a provision is invalid or unenforceable, it will be severed or limited to the extent necessary. The remaining provisions will continue in effect to the extent permitted by law.
